Weinstein’s attorney also known as the sentence”unconstitutional” in an appeal that takes aim at exactly what his attorneys characterize since the trial judge’s outburst over Weinstein bringing mobile phones into courtroom.
“Mr. Weinstein, I could not implore you to not answer the following question: is this the way that you wish to end up in prison for the rest of your life, by texting in violation of an order?” Judge James Burke stated in a remark that sparked a recusal motion. “Is it?”
Weinstein’s criminal exposure, along with also his counterattack, are far from over.
Appearing virtually from prison until Erie County Court Judge Kenneth Case at Buffalo, New York, Weinstein said small as his attorney Effman signaled his client currently has the option to create a movement for Gov. Andrew Cuomo to deny the request. Cuomo could theoretically decide to stop Weinstein’s transfer on his own, but there’s been no indication that the governor would be prepared to do so.
“So that 30 day grace period is in performance, however I also feel that the compact, as well as the statute, indicates that he was still should be brought prior to an Erie County courtroom if he fails to waive extradition about the paperwork that he was supplied while still incarcerated,” Effman said. “So just because we did the last time, I believe we’d return in front of a judge, and there will be no waiver.”
