Disgraced Producer Harvey Weinstein May Be Extradited to California by End of May

Harvey Weinstein’s lawyer on Friday signaled plans to resist his client’s extradition to Los Angeles following a grand jury indictment from California. Despite that risk, a New York judge indicated the procedure could wrap up when May 30.
“That is a brand-new day,” Weinstein’s lawyer Norman Effman stated in court today. “As I said, Groundhog Day is started again.”
Convicted in New York for rape and other fees, Weinstein has been enticing his 23-year sentence about the East Coast while concurrently hoping to fend off his transfer to California, in which he also confronts sexual assault charges involving alleged misconduct supporting five women from 2004 to 2013.
Though the verdict shielded Weinstein from a possible life sentence, a judge sentenced the 69-year-old toward the upper end of the possible range. Weinstein’s attorney also known as the sentence”unconstitutional” in a charm that takes aim at what his lawyers characterize since the trial judge’s outburst over Weinstein bringing mobile phones into court.
“Mr. Weinstein, I could not implore you to not answer the following question: is this really the way you wish to end up in jail for the rest of your lifetime, by texting violation of the order?” Judge James Burke said in a comment that ignited a recusal motion. “Is it?”
Weinstein’s criminal vulnerability, along with also his counterattack, are far from over.
Appearing virtually from prison until Erie County Court Judge Kenneth Case in Buffalo, New York, Weinstein said little as his attorney Effman signaled his client currently has the option to create a motion for Gov. Andrew Cuomo to deny the request. Cuomo could decide to stop Weinstein’s transfer by himself, but there’s not been any sign the governor would be eager to do so.
“So that 30 day grace period is currently in operation, however I also believe that the — the compact, in addition to the statute, suggests that he was still must be brought prior to an Erie County court if he does not waive extradition about the paperwork that he was provided while incarcerated,” Effman said. “So just because we did the last time, I think we’d be back before a judge, and there will be no waiver.”
The other West Coast fees against Weinstein include forcible rape, forcible oral copulation, sexual penetration by use of pressure, along with sexual battery by restraint, stemming from allegations that he attacked two women in 2013.
“We are willing to defend Harvey against those spurious charges, but not unless he’s first permitted a just and legal extradition procedure that will account for his continuing medical treatment in New York along with also the fact that COVID still prevents him from having an in-house trial in the Los Angeles courts for the foreseeable future,” defense attorney Mark Werksman said in a statement following the hearing.
Weinstein could face additional decades behind bars if convicted on the West Coast, but the former film producer’s lawyers hope to prevent the process from happening.
“So I shall await paperwork out of you , in the event that you so choose, and , the 30 day period has begun, which will be till May 30,” Judge Case said.
